1. Activation and nature of 911 service
Outsource IT's 911 service is available upon service activation, and applicable 911 fees are charged as of the service activation date. The 911 service provided by Outsource IT differs in a number of important ways from traditional 911 or E911 dialing available with most traditional telephone services, and it has specific limitations relative to Enhanced 911 (E911).
2. E911 versus Basic 911 service
With E911 the caller's telephone number and location are automatically transmitted to the operator. With Basic 911 (B911) they are not. The operator verbally obtains the information that identifies the caller's need and physical location, determines the appropriate agency, and transfers the caller. Outsource IT provides a Basic 911 type service.
3. 911 service description
When a user dials 911 the call is routed from the Outsource IT network to our emergency services operator. The user confirms whether they are still at the address registered with Outsource IT, or provides their current location. The operator then determines the appropriate emergency agency and transfers the call. There may be additional delay in areas not served by traditional 911. Do not hang up unless instructed. The customer must provide a service address for each activated or ported DID and keep that information current at all times. Only DIDs or charge numbers provisioned with Outsource IT, with applicable fees paid, may be used as the Calling Party ID for 911 calls. If a user is unable to speak, our operator dispatches emergency services to the address on file. Outside Canada and the United States, users must hang up and dial local emergency services.
4. Power or broadband outage
A power failure or disruption may require equipment to be reset or reconfigured before using the service. Power failures, ISP outages, partial outages, or service suspension are likely to prevent dialing emergency numbers including 911. In those events a traditional telephone or cellular telephone may be required to make an emergency call. Service may not function during any outage, malfunction, or unavailability of the internet connection or related equipment, and the customer continues to be billed until the service is terminated in accordance with this agreement.
5. Informing others of the 911 service limitations
The customer must inform users and potential users of the limitations of Outsource IT's 911 service compared with traditional 911 service. If a user is not comfortable with those limitations, the customer should arrange an alternate means of accessing traditional 911 services.
6. Limitation of liability and indemnification
Neither Outsource IT, its affiliates, nor their respective officers, directors, employees or agents may be held liable for any claim, damage or loss (including profit loss) or any damage resulting from a service outage or data loss. The customer waives all such claims arising from any service outage or inability to dial 911, unless the act or omission proximately causing the loss constitutes gross negligence, recklessness, or intentional misconduct on the part of Outsource IT. Outsource IT provides no other warranties, express or implied, including merchantability and fitness for a particular purpose. The customer agrees to defend, indemnify and hold harmless Outsource IT, its affiliates and their representatives from all claims, losses, damages, fines, penalties, costs and legal fees relating to the absence, failure or outage of the service, including 911 dialing and misrouted 911 calls.
8. Updates to 911 service terms
The information contained in this VoIP 911 service agreement, and any updates or revisions, are published on this page.
9. Express consent
The customer acknowledges that Outsource IT is not responsible or liable for any of the conditions described in this service agreement which may impede VoIP 911 service. The customer understands and agrees to the limitations of Outsource IT's 911 service and agrees to hold Outsource IT, its affiliates and their respective officers, directors, employees and agents harmless for any injury or damage, whether direct or indirect, that may result from use of the service.
